1. Educational Purpose
BlueStorm is a tool designed and provided exclusively for educational and research purposes in the field of Bluetooth/BLE security. This tool is intended to be used by security researchers, professionals, and students to learn about and understand Bluetooth security mechanisms.
2. Legal Compliance
2.1 United States Laws
Users must comply with all applicable U.S. federal and state laws, including but not limited to:
- Computer Fraud and Abuse Act (CFAA) - 18 U.S.C. § 1030
- Electronic Communications Privacy Act (ECPA) - 18 U.S.C. § 2510-2522
- Digital Millennium Copyright Act (DMCA) - 17 U.S.C. § 1201
- Wiretap Act - 18 U.S.C. § 2511
- Federal Communications Commission (FCC) regulations - 47 CFR Part 15
U.S. Legal Consequences:
- CFAA Violations: Up to 10 years imprisonment and/or fines up to $250,000 (18 U.S.C. § 1030(c))
- ECPA Violations: Up to 5 years imprisonment and/or fines up to $250,000 (18 U.S.C. § 2511)
- Wiretap Act: Civil damages of $100 per day or $10,000, whichever is greater
- FCC Violations: Fines up to $10,000 per violation and device seizure
2.2 Philippine Laws
Users in the Philippines must comply with:
- Republic Act No. 10175 (Cybercrime Prevention Act of 2012)
- Republic Act No. 8792 (Electronic Commerce Act of 2000)
- Republic Act No. 10173 (Data Privacy Act of 2012)
- NTC Memorandum Order 02-03-2016 (Radio Control Law)
- DICT Department Circular No. 003 s.2019
Philippine Legal Consequences:
- Cybercrime Law Violations (RA 10175):
- Imprisonment of 6-12 years and/or fines of ₱200,000 to ₱500,000
- Additional penalties for unauthorized access and system interference
- Data Privacy Act Violations (RA 10173):
- Imprisonment of 3-6 years and fines of ₱500,000 to ₱4,000,000
- Additional penalties for unauthorized processing of personal data
- NTC Radio Control Law Violations:
- Fines up to ₱200,000 per violation
- Device confiscation and license revocation
3. Prohibited Activities
The following activities are strictly prohibited and may result in criminal prosecution:
- Unauthorized access to Bluetooth devices without explicit owner consent
- Interception or modification of Bluetooth communications without authorization
- Use of BlueStorm for malicious purposes or cyber attacks
- Distribution of captured personal or sensitive information
- Commercial exploitation of security vulnerabilities
- Bypassing security measures of protected devices
4. Disclaimer of Liability
The creators, developers, and contributors of BlueStorm explicitly disclaim any responsibility for misuse of this tool. Users are solely responsible for:
- Ensuring compliance with all applicable laws and regulations
- Obtaining necessary permissions and authorizations
- Any consequences resulting from the use or misuse of the tool
- Any damage or loss caused to devices or systems
- Any legal implications arising from unauthorized use
